  • “Auction” refers to the timed sale process where users place competing bids to purchase a listed product.
  • “Bid” refers to an offer made by a user during an auction.
  • “Deposit” refers to a pre-authorized or charged monetary amount required before bidding to verify user seriousness.
  • “Wallet” refers to the user’s internal digital balance account on our website where refunds or credits may be held.
  • “User” refers to any individual or entity registered on the website.

3. Scope of Services

Sweden Capital Group operates a digital auction platform where:

  • Sweden Capital Group and third-party suppliers can list items or assets for auction.
  • Registered users can participate in auctions by submitting legally binding bids.
  • The highest bidder at the end of an auction is obligated to complete the purchase according to the rules set forth in this document.

4. Eligibility and User Registration

To register and use our services:

  • You must be at least 18 years of age and legally capable of entering binding contracts.
  • You must provide accurate, complete, and up-to-date information at the time of account creation.
  • You must link a valid payment method (such as a debit/credit card) to your account before bidding.
  • You are solely responsible for maintaining the security and confidentiality of your account credentials.
  • You may not register or operate more than one account without our written permission.

We reserve the right to suspend, block, or delete any account that we believe has violated these Terms or our policies.

5. Auction Rules

5.1 Binding Nature of Bids

  • Every bid placed on the platform is legally binding.
  • Once you place a bid, you cannot cancel, withdraw, or dispute it unless due to proven technical error.
  • The highest bidder at the close of an auction is deemed the “Winning Bidder.”

5.2 Auction Conduct

  • All auctions are managed and timed by our Platform.
  • Auction time and listing details are displayed on each product page.
  • We reserve the right to extend, pause, cancel, or reschedule auctions at our sole discretion, including due to system errors, suspected fraud, or technical issues.

6. Deposits and Bidding Requirements

6.1 Mandatory Deposit

  • A predefined deposit is required before participating in any auction.
  • You authorize us to charge this deposit at any time, even without prior notice, upon entering an auction.
  • This deposit confirms your commitment and discourages non-serious bidders.

6.2 Deposit Outcome

  • If you win the auction and complete payment: the deposit is held securely until legal documentation is finalized.
  • If you win the auction and fail to pay: the deposit is forfeited permanently without exception.
  • If you do not win the auction: the deposit is refunded to your internal wallet (not directly to your bank account).
  • Deposit funds in your wallet can be used for future auctions or withdrawn per our internal processing time.

7. Payment Terms

  • If you are declared the winning bidder:
    • You must pay the full auction amount within five (5) calendar days of the auction closing.
    • Failure to pay in time will forfeit your deposit, and we may relist the item or offer it to the next highest bidder.
  • All prices are in Swedish Krona (SEK) unless stated otherwise.
  • We accept payments via third-party processors. We are not liable for transaction issues caused by your bank or payment provider.
  • All sales are final; no returns or cancellations are permitted once payment is completed.

8. Legal Documentation

  • For items requiring ownership transfer or legal certification (e.g., vehicles, properties, licenses), Sweden Capital Group will:
    • Initiate and complete all legal documentation within 90 business days from the date full payment is received.
  • If we fail to deliver the documentation within this time, you may submit a formal refund request.
  • Sweden Capital Group shall not be liable for delays caused by third parties, public authorities, or international regulations.

9. Supplier Listings Disclaimer

  • Items listed by third-party suppliers are managed and described by those suppliers.
  • While we review listings, we do not guarantee the accuracy, availability, or legality of any third-party product.
  • You agree that any dispute, issue, or claim with a third-party listing must be resolved between you and the supplier.
  • Sweden Capital Group disclaims all responsibility for third-party product quality, defects, delays, or failure to deliver.

10. User Conduct

You agree not to:

  • Manipulate auction outcomes (e.g., shill bidding or collusion)
  • Submit false information or stolen payment data
  • Abuse or harass other users
  • Circumvent, hack, or reverse-engineer our platform
  • Violate local, national, or international laws while using our services

We may suspend or ban accounts found in violation and pursue legal action if necessary.

11. Disclaimer of Warranties

  • All services are provided “as is” and “as available.”
  • We do not warrant that the platform will be uninterrupted, error-free, secure, or meet your expectations.
  • We make no warranties, express or implied, regarding the merchantability or fitness for a particular purpose of any item sold or auctioned.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Sweden Capital Group, its employees, directors, affiliates, and suppliers shall not be liable for:
    • Losses from failed or delayed payments
    • Misuse of your account or data breaches beyond our control
    • Damages from third-party listings or undelivered items
    • Delays or failures due to government or legal processes
    • Indirect, incidental, special, or consequential damages

If liability is established, it is strictly limited to the amount you paid for the disputed transaction.

13. Indemnification

You agree to indemnify and hold harmless Sweden Capital Group and its affiliates against all claims, losses, liabilities, damages, legal costs, or demands arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your infringement of third-party rights or laws

14. Termination of Access

We reserve the right to:

  • Suspend or terminate your account without notice for violations
  • Cancel or reschedule any auction without reason
  • Remove listings at our sole discretion

Termination does not affect your obligations under these Terms.

15. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of Sweden. Any disputes or legal proceedings shall be subject to the exclusive jurisdiction of Malmö District Court or any competent court in Sweden.
